General conditions

The goods and services covered by these general conditions are offered for sale by Wink di Fabrizio Stronati, via Monte Venanzio 7, 60128 Ancona, sole proprietorship with and ATECO (46.74.1), company registration number AN208547, tax code and VAT number 02704170428, hereinafter referred to as “Wink”.

Article 1 – Acceptance of the general conditions of sale
Before proceeding with the purchase of Wink Products according to the methods established in these general conditions and indicated on the website www.wink-tools.eu, the Customer expressly declares to have read carefully and to have fully accepted the content of these General Conditions as well as having read every indication provided during the purchase procedure. Wink invites you to keep a copy of these general conditions for prompt consultation. These general conditions of sale are an integral part of any purchase order and contract for the sale of the Products marketed by Wink on the website www.wink-tools.eu, in force on the date of the relative order.

Article 2 – Definitions
The term ” General Conditions ” means this document.
The term ” Customer ” generally refers to the person, whether a consumer or professional, who makes a purchase of WInk Products according to the indications on the Site and in the General Conditions.
The term ” Products ” means all the products marketed by Wink on the website www.wink-tools.eu and forming part of its assortment.
The term ” Site ” means the set of Web pages accessible by typing the url: www.wink-tools.eu
With the term ” Purchase Order“Means the order by the Customer – containing the details of the Product that is generated by the system following confirmation of payment.
The term ” Sales Agreement ” means the sales contract concluded between the Customer and Wink with the Purchase Order confirmed by Wink following payment of the specified amount.

Article 3 – How to stipulate the contract
The Customer can purchase the Products as illustrated in the information sheets on the pages of the Site. The Customer, by carrying out the purchase procedure indicated on the Site, can choose the Products of his interest, check the total value of the Products he intends to purchase including the relative delivery costs. The Purchase Order, once finalized with the payment, cannot be modified or canceled. All Purchase Orders must be exactly completed in their entirety and must contain the exact identification of the Products ordered, the Customer and the place of delivery of the Products. The Purchase Order is valid as a contractual proposal of the Customer manifested online. The order confirmation by Wink, sent to the Customer at the e-mail address indicated by him,confirms the order data and is valid as acceptance of the contract proposal. The Order Confirmation by Wink will take place only after the payment of the Products specified in the Purchase Order. The contract is concluded and is binding for both parties when the purchase order confirmation is sent to the customer. The Order Confirmation will contain a summary of the order, which shows the details of the order, the price of the purchased good, the shipping costs and any additional accessory charges, the address where the Product will be delivered, the type delivery chosen by the Customer. Wink reserves the right to refuse the purchase proposal sent, by way of example and not limited to in the following cases: supply of non-real personal data;previous non-fulfillment for any reason against Wink, subjecting to bankruptcy procedures, lack of availability of the Products – for any reason – in the warehouse and in any other case incompatible with the economic interests and company policies.

Article 4 – Methods of payment and reimbursement
Each payment by the customer can be made by credit card. To make a payment by credit card, the customer will be redirected to the secure server of the bank chosen by Wink; therefore all information related to the payment (credit card number, its validity, etc.) will be sent directly to the bank of reference. The most common credit cards are accepted, including prepaid and rechargeable: Visa, Mastercard, American Express and Diners. When paying by credit card, no supplement will be charged. With the insertion of the credit card data, the payment is immediately made with simultaneous debit on the credit card in the manner provided by the credit card manager.If the bank informs Wink of any irregularity relating to the credit card used, the latter will proceed with the cancellation of the order. Any reimbursement to the Customer will be credited using one of the methods used by Wink. If the refund is made by bank transfer, it can be finalized only if the holder of the current account is the same person who placed the Purchase Order. In case of exercise of the right of withdrawal by the Customer, Wink will credit the refund within a reasonable period from the date on which the latter became aware of the withdrawal. In case of exercise of the right of withdrawal, Wink will not be required to reimburse the additional costs,if the Customer has expressly chosen a type of delivery other than and more expensive than the standard one proposed by Wink. However, Wink reserves the right to withhold the reimbursement until it has received the goods and verified their integrity.

Article 5 – Delivery times and methods
Wink will deliver to the Customer the Products, selected and ordered in the manner specified in the Order Confirmation specified in art. 3, through trusted couriers and / or forwarding agents. The different methods, times and shipping costs will be clearly indicated on the Site at the time of purchase. The delivery times indicated on the Site at the time of purchase will be purely indicative and the methods and timing of contact with the Customer – prior to delivery or after the first delivery attempt – will depend on the courier chosen by Wink in relation to the specific type of order to be delivered. Delivery will be made to the address indicated by the Customer at the end of the purchase process on the Site. The Customer, during the formulation of the Purchase Order on the Site,undertakes to verify that the information provided is correct and complete. The delivery will reflect the characteristics of the type chosen at the time of purchase. Any impediment or particular condition linked to the access routes to the address indicated that would prevent or make the delivery less easy, must be communicated by the Customer. It should be noted that in pedestrian areas, delivery will take place up to the point where the vehicle will have access. If not included in the Delivery Service specified in the Purchase Order, no porterage inside the customer’s home can be requested from the Delivery Service staff. The fiscal documentation (invoice) is published, starting from the shipment of the Product,in the area of ​​the Site reserved for the Customer which the same can access using their login credentials or sent in digital / paper form. As regards the delivery document (delivery note and / or delivery note), it will be issued by Wink, and will be signed by the Customer at the time of delivery. Upon delivery of the Product by Wink, the Customer is required to check that the number of packages delivered corresponds to what is indicated in the courier’s accompanying document and that the packaging is intact, not damaged, wet or altered. Once the Courier’s transport document has been signed, the Customer will no longer be able to make any objection about the quantity and quality of what has been received.The customer can always check the status of the Purchase Order through the website in the reserved area if he has registered or by contacting Customer Service.

Article 6 – Prices
All the sales prices of the products indicated on the Site are expressed in euros including VAT, any other tax and, where required by applicable legislation, include the WEEE eco-contribution. Shipping costs and any additional charges, if any, are indicated and calculated in the purchase procedure and clearly specified in the Purchase Order and in the Order Confirmation.

Article 7 – Liability
Wink assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that it is unable to execute the order within the time stipulated in the contract. The description on the Site of each item is only indicative, has no contractual character and Wink cannot be held responsible in the event of unavailability of one or more products. Furthermore, Wink will not be liable for damages, losses and costs incurred by the Customer as a result of the non-execution of the contract for reasons not attributable to him, as the Customer is only entitled to a full refund of the price paid and any additional charges incurred.

Article 8 – Right of withdrawal
Without prejudice to the provisions of article 9, the Customer has in any case the right to withdraw from the contract stipulated on the Site, without any penalty and without specifying the reason, within the term of 14 (fourteen) days, starting from the day of the ” purchase of the Service or receipt of the purchased Product. The right of withdrawal may concern all the Products and Services purchased or only part of them. For the purposes of exercising the right of withdrawal, the Customer may return the Product, purchased online, at one of the Wink stores of his choice on the Italian territory as long as it is within 14 days following the date of delivery of the Product. In this case, you must go to the shop with a copy of the purchase invoice and the product. Alternatively,for the Services and Products purchased, the Customer may exercise the right of withdrawal by notifying Wink by filling in the digital form on the website www.wink-tools.eu, indicating the “Right of withdrawal” as a reason. Alternatively, the Customer may also send a written notice of withdrawal, by postal service, again within 14 days of delivery of the goods, to Wink., Via Monte Venanzio 7, 60128 Ancona, specifying the will to withdraw from the purchase and the Product for which it intends to exercise the right of withdrawal; this form may also be used for this communication (download form).The return of the Product must in any case take place at the latest within 14 (fourteen) days from the date of confirmation that Wink will give following the communication of the decision to withdraw from the contract and must be made to the address that will be specified to the Customer or at one of the shops. Wink chosen by the customer present on the Italian territory. In case of shipment, the date of delivery to the post office or courier will be valid between the Parties. In any case, in order to be entitled to a full refund of the price paid for the purchase of the Product, the latter must be returned intact and, in any case, in a normal state of conservation. The costs of returning the product are charged to the customer. Wink will refund the price paid by the Customer as specified in Article 4.
In case of purchase of the product via Paypal, the refund following the return will be made only by crediting the Paypal account.

Article 9 – Right of return
Senza alcun pregiudizio per l’esercizio del diritto di recesso di cui all’articolo 8, il Cliente che ha acquistato un Prodotto ha la possibilità di restituire il Prodotto acquistato entro 100 giorni dall’acquisto o dalla consegna nei termini e con le modalità di cui infra. Il Cliente, indipendentemente dalle modalità d’acquisto del prodotto, potrà restituire il prodotto recandosi direttamente nella sede Wink, munito di scontrino o di fattura. Il Cliente avrà la possibilità di ricevere, all’atto della restituzione, un buono acquisto rimborsabile valido 6 mesi. In ogni caso, il Prodotto reso dovrà essere integro, in normale stato di conservazione, imballato nella confezione originale e completo di ogni accessorio, dei manuali di istruzione e di tutto quanto in origine contenuto nell’imballo originale. Per consentire la corretta evasione della richiesta di reso on line il Cliente dovrà rispettare modalità e termini di accettazione della richiesta comunicati via mail da Wink; in mancanza di accettazione da parte del Cliente Wink non potrà dare seguito alla richiesta di reso. Si precisa che la spedizione del Prodotto dovrà avvenire non oltre 30 giorni dalla compilazione della richiesta di reso via web; a seguito della richiesta verrà fornito al Cliente un codice identificativo del reso (numero di pratica) che dovrà sempre essere comunicato al corriere prescelto per la riconsegna del bene, in modo che lo possa sempre indicare nella ricevuta di consegna. Ove non diversamente comunicato, le eventuali spese di restituzione del Prodotto sono a carico del Cliente. In ogni caso, per avere diritto al rimborso del prezzo del Prodotto, quest’ultimo dovrà essere restituito integro, in normale stato di conservazione, imballato nella confezione originale e completo di ogni accessorio, dei manuali di istruzione e di tutto quanto in origine contenuto nell’imballo originale. Il rimborso del prezzo di acquisto del Prodotto oggetto di reso, verrà accreditato al soggetto che ha finalizzato l’ordine, mediante una delle modalità in uso presso Wink in un congruo termine, e solo a seguito dell’esito positivo del controllo del Prodotto ricevuto.

Article 10 – Method of archiving the contract
Pursuant to art. 12 of Legislative Decree 70/2003, the Wink informs the customer that every order sent is stored in digital form according to criteria of confidentiality and security. Article 11 – Communications and Customer Relationship Service For any communication or request for clarification, the Customer must contact the Assistance service. The Customer will indicate in the registration form on the Site his residence or domicile, the telephone number or the e-mail address to which he wishes the communications to be sent.

Article 12 – Applicable law and competent court
These General Conditions of Sale are subject to Italian law. Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the Customer.
